Biography

Ms. Sarah McKinlay served as Partner and Head, Private Client at HBJ Gateley. She is head of the Private Client team in Scotland and advises clients on the use of tax efficient wills and the creation and management of trusts. She takes a proactive approach to the review of client's personal planning across their wills and trusts, Inheritance Tax (IHT) strategies (including maximising tax relief through Business Property Relief), pension benefits and planning, life policies and the making of lifetime gifts. Sarah provides advice to financial advisors, business owners and family lawyers and works closely with colleagues in the Family Law, Corporate and Financial Planning teams in particular. She holds the Diploma in Financial Planning and is Level 4 compliant under RDR. This unlocks the ability to provide financial planning combined with legal advice across a wide range of individuals and families. Sarah has a particular interest in advising on the legal, business and tax issues involved in planning business succession. She also has considerable experience in the administration of executries (including those with complex tax or foreign issues), incapacity issues, guardianship orders, powers of attorney, charities and partnerships. She is a Writer to the Signet, Notary Public, member of the Chartered Insurance Institute and member of the Personal Finance Society. Advised Trustees of a family trust in respect of a previous administration dispute and establishing an investment and tax strategy for the next generation going forwards. Negotiation of a contentious executry dispute. Implemented a succession plan including Inheritance Tax mitigation strategy for an individual post business sale. Capital Gains Tax advice for a separated client on the proposed sale/transfer of private company shares.
