Biography

Mr. Daniel Hettich serves as Partner, Healthcare at King & Spalding. He is a partner in King & Spalding's Washington D.C.'s Healthcare Practice Group and a vice-chair of the American Health Lawyers Association's Regulation, Accreditation and Payment (RAP) practice group since 2013. Mr. Hettich advises health care providers on a full range of legal issues surrounding Medicare reimbursement and advocates on their behalf before various administrative and judicial bodies. In this capacity, he has won final, favorable decisions overturning agency denials of new residency program status, provider-based status, critical access hospital status, and volume decrease adjustments. Mr. Hettich has assisted or led in the prosecution of dozens of appeals before the Provider Reimbursement Review Board and is facile in both the procedural rules and substantive Medicare reimbursement law, underlying these disputes. While Mr. Hettich's experience begins at the agency level, it extends all the way to the D.C. Circuit Court of Appeals where he helped achieve a favorable decision on an inpatient Medicare reimbursement issue worth millions of dollars a year to his client. He regularly advises his clients on various aspects of Medicare reimbursement and related issues such as successor liability issues associated with changes of ownership, False Claim Act liability, graduate medical education payments, disproportionate share payments, and Medicare bad debts. He has drafted numerous comment letters and white papers on behalf of industry stakeholders. he is a frequent speaker at AHLA's annual Institute on Medicare and Medicaid Payment and has also presented at the AHLA's annual meeting, the AHLA's Hospital and Health Systems Law Institute, the ABA's Health Law Summit, and for RACMonitor. He was named an AHLA pro bono champion three years in a row (2010-2012).
